Privacy policy

Nexxus Nightwatch needs no account. Your progress stays on your device. This page explains which data still leave your device, where they go and what we keep. It applies to nexxusnightwatch.com and to the app on iPhone, iPad and Android.

Who is responsible

The controller for your data is Phillip Kracht, the provider of Nexxus Nightwatch. For questions about privacy, write to play@nexxus.group.
Address and phone number in the legal notice

What is stored on your device

Your progress stays on your device: which devices and services you have selected or deselected, which items you have marked as done, skipped or “doesn’t apply”, which ones you have reset, which version of the guide applied when you marked an item, plus the depth, each with the time of the last change. It goes to no Nightwatch server.
Also on the device are your language and appearance, the most recently loaded content, the day you first started the app, which services Nightwatch has already introduced to you, which guides have been seen and which reports have been read (separately for each person, so Nightwatch can mark what is new) and whether you closed the notice about a new version in the store. If you open sharing or receive progress, the device also keeps the identifiers for sharing, for each person the time you last opened sharing or received progress for them, the name you gave Nightwatch for yourself as well as the name of the person who set up Nightwatch for you. In the app, this also includes your family members with their names, where they live (in Europe or not) and their progress, whether Nightwatch has already asked you about your family, as well as your settings for alerts and the monthly check-in. The app also remembers when background fetches ran, when the last alert came and which news it has already told you about. It also remembers whether you have Plus, until when and which system version your device last had. In the browser, only what is needed there is stored, in the browser’s local storage. If you delete the site’s data or the app, all of it is gone.
This does not apply if your device backs up the app’s data: in iCloud Backup on iPhone and iPad, in Google backup on Android. Then your progress comes back with the backup. Whether the app is included depends on your settings.
Nightwatch does not read any privacy settings of your device or your accounts. You mark what is done yourself. The app reads your device’s language to show the right one and the operating system version for the notice after a system update. If alerts are on, it also reads whether notifications and background fetches are allowed. In the browser it is only the language. All of this stays on the device.

Loading content

The items and guides come from our server. It is located in a data center run by Hetzner Online GmbH in Germany. At start and each time you return to Nightwatch, the app and the website ask there whether there is new content and load it if needed.
The server processes your IP address so that the response reaches you. The request contains which file is loaded and thereby the language of the content. Like any request on the web, it also carries technical details of your browser or app, such as the language set and the program version. It contains no identifier of your device and nothing about your progress.
We keep no access log. Our error logs contain no IP addresses of your visits either. We build no profiles and do not analyze the addresses.

Website

nexxusnightwatch.com works without cookies, tracking, analytics or ads. Fonts and all other files come from our own server. When you open a page, it processes your IP address to send you the page. It does not store it.
In the app and on the website, for each item we link to the official guide by the maker, such as Apple or Google. Where there is one, we also link to the provider’s settings page. Reports link to their source, for example a trade magazine or an authority. If you follow one of these links, you leave Nightwatch. That provider’s privacy policy then applies.
Our backups hold no data about you: Nightwatch has no database. The server only holds the pages and the guides.

Sharing

You can share your progress and that of your family members with another device using a QR code or a link. The progress is in the link itself, after the “#” character. It includes the family member’s name, the system of their device if one is known, the selected devices and services, which items are done, skipped or “doesn’t apply”, which items you reset and which services you selected or deselected, each with date and time, as well as the depth with the time of its last change and the language. For items you marked, the link also contains the version of the guide that applied at the time, if it is known. It also contains random identifiers that let the other Nightwatch recognize who the progress belongs to. The link also says whether you are sharing yourself or a family member. If you have told Nightwatch a name for yourself, it is in the link too. If you share yourself, the link says whether your device is in Europe. In the app, Nightwatch determines this from the time zone, otherwise from the region in your device’s language settings. If neither is available, it assumes Europe. In the browser, Nightwatch always assumes Europe. Browsers and the app do not send this part to our server. When the link is opened, our server only receives the page request, as described under “Website”.
The safest way is for the other device to scan the QR code. If you send the link through a messenger or by email, that service receives the link and can read the shared progress. If a browser opens the link, it is stored in its history. If your browser syncs its history, the link is also stored with the browser’s provider.

Alerts

With Plus you can turn on alerts. The app then fetches our content in the background, just as when you open it (see “Loading content”). Your device decides when this happens. If there is something new about the devices and services you chose, the app creates a notification itself. Once a month it also schedules a check-in, which you can turn off.
Notifications are created only on your device. We do not use a push service. What a notification says goes to no one, neither to us nor to Apple or Google. If you do not allow notifications, Nightwatch shows what is new when you open it.

App updates

At start and when you return, the app on iPhone, iPad and Android asks our server for updates. That way improvements reach you without a detour through the store. The request states the platform, the app version and which update is currently running. The update technology also sends a random identifier that it creates on your device for this installation. If the app crashed before, it also sends the error message. Our server reads only the platform and version to send the matching update. It does not read the identifier or the error message. None of it is stored.
Once per start, the app asks our server which version is in the store, so it can show you a new version. The same applies as under “Loading content”.
Every update is signed with our key. The app accepts only updates whose signature matches.

Purchases

You buy Nightwatch Plus in the app through Apple’s App Store or through Google Play. The store handles the purchase and payment, under its terms and its privacy policy. We receive no payment details from you.
When you open the purchase page, the app asks the store for the price. When you buy or tap “Restore purchase”, it asks the store for your purchases. If you have made a purchase, it also asks at start and each time you return. It asks in the background too when your subscription may have expired. This tells the store when you use Nightwatch. The result stays on your device.
For billing and taxes, Apple and Google show us information about the purchases. Apple shows it to us in aggregate, for example the number, country and amount per day. For each purchase, Google shows us the order number, date, product, price, tax and country, along with the other purchases by the same customer. Google does not show us your name or your email address. If we know your email address, for example because you wrote to us, we can look up your purchases in Google’s overview. We keep this information for as long as tax and commercial law require it, usually ten years.

Rating and recommending

After a few days, the app may ask you for a rating. For this it uses the dialog from Apple or Google. What you enter there goes directly to the store. “Rate Nightwatch” opens the app’s page in the store. “Recommend Nightwatch” opens your device’s share menu with a sentence and the link to nexxusnightwatch.com. You decide where to send it.

Who receives data

Besides us, these companies receive data: Hetzner Online GmbH for the data center in Germany and united-domains GmbH in Germany, which holds emails sent to play@nexxus.group. If you open the purchase page, buy Plus or rate the app, Apple or Google receives the data involved (see “Purchases” and “Rating and recommending”). We pass data on to no one else. We do not sell data.

Legal bases

We load content and, if you turn them on, run alerts to provide the feature you use in Nightwatch (Art. 6(1)(b) GDPR). The same applies to purchases. We rely on our legitimate interest (Art. 6(1)(f) GDPR) for running and securing the server and for app updates.
We keep information about purchases because tax and commercial law require it (Art. 6(1)(c‌) GDPR). If you write to us, we use your email to reply (Art. 6(1)(f) GDPR). We delete it once the matter is settled, unless the law requires us to keep it.
What the app stores on your device and reads there is needed for the features you use (Section 25(2) No. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG)).
Nightwatch makes no automated decisions about you and builds no profiles.

Your rights

You have the right of access, rectification, erasure, restriction of processing and data portability.
We hold no data about your use that we could link to you. You delete your progress yourself by deleting the app or the website’s data. If you have made a purchase or written to us, tell us the order number or the email address. We will then find what we hold about it.
You can complain to a data protection authority, for example in your country. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of Mecklenburg-Western Pomerania.

Your right to object

Where we rely on our legitimate interest (Art. 6(1)(f) GDPR), you can object at any time on grounds relating to your particular situation. To do so, write to play@nexxus.group.
